Thesis for receiving the scientific degree of the Candidate of Political Sciences, specialty 23.00.01 – Theory and History of Political Science. – Kharkiv V.N. Karazin National University. – Kharkiv, 2018. The thesis is devoted to the study of the concept of the state of law in the political theory of C. Schmitt in the framework of the phenomenon of a strong total state. It is confirmed that the origins of the concept of law and state are embodied in the ideas of ancient thinkers, aimed at rationalizing social life on the basis of laws in order to achieve good and justice for all individuals united in a single structure. The state is interpreted as the creation of the people; the will of the people is the source of all that is understood under the law. That is, the Roman state is not simply a community, but goes up to the level of the people's state, the republic. The provisions of the ancient political and legal thought laid the foundations for the formation of the principles of the rule of law.
dc.description.abstract	Дисертацію присвячено дослідженню поняття правової держави в політичній теорії К. Шмітта крізь призму феномену сильної тотальної держави. Підтверджено, що джерела поняття права й держави закладені в ідеях античних мислителів. Проаналізовано підходи до поняття держави за середньовіччя. Ідея правової держави значно розвинулася в німецькій політичній думці ХІХ ст. Визначено роль принципів правової держави в сучасній політичній науці.
