Історія реституції в Україні (на прикладі пам’яток мистецтва)

Abstract

Tема даної роботи охоплює історію та розвиток процесу реституції в Україні у період з кінця ХХ століття і по сучасність. Процес реституції відіграє важливу роль у державній політиці різних країн так як за допомогою міжнародних норм дозволяє відновлювати право власності і повертати історичні та культурні цінності, які внаслідок різних геополітичних процесів потрапили за межі країни свого походження. Питання реституції завжди було актуальним для України, так як протягом багатьох століть її культурна спадщина, яка є відображенням самобутності та унікальності держави, зазнавала розкрадань та знищення. Саме тому, зі здобуттям незалежності, реституція посідала важливе місце у державній політиці України. Це проявлялося у створенні державних органів, основними завданнями яких був розшук, повернення та захист культурних цінностей, розробка нормативноправових актів і міжнародна співпраця. У роботі досліджено і визначено діяльність, виклики й досягнення у вирішенні питань реституції такими установами як Національна комісія з питань повернення в Україну культурних цінностей, Державна служба контролю за переміщенням культурних цінностей через державний кордон України та Міністерство Культури України.The topic of this work covers the history and development of the restitution process in Ukraine from the end of the 20th century to the present day. The process of restitution plays an important role in the state policy of various countries, as it allows, through international law, to restore ownership rights and return historical and cultural values that, as a result of various geopolitical processes, have been far from country of its origin. The issue of restitution has always been relevant for Ukraine, as for many centuries its cultural heritage, which is a reflection of the identity and uniqueness of the country, experienced theft and destruction. That is why, with the gaining of independence, restitution occupied an important place in the state policy of Ukraine. This was manifested in the creation of state agency whose main tasks were the research, return and protection of cultural values, the development of regulatory legal acts and international cooperation. The work examines and identifies the activities, challenges, and achievements in resolving restitution issues by such institutions as the National commission for return the lost cultural values to Ukraine, the State Control Service for supervising the displacement of the cultural values over the state border of Ukraine, and the Ministry of Culture of Ukraine.
