Конституційні цінності в умовах формування України як правової держави

Abstract

У дисертаційному дослідженні надано змістовну характеристику соціально зумовленим трансформаційним процесам у сфері реалізації конституційних цінностей громадянського суспільства. У процесі дослідження висвітлено найважливіші ключові аспекти провідних інститутів громадянського суспільства, визначено їх роль у процесі формування правової державності, охарактеризовано змістовні напрями взаємодії з державою в аспекті гарантування конституційних цінностей, проаналізовані новації українського законодавства та виявленні їхні практико-реалізаційні недоліки. Підкреслено значущість конституційних цінностей у сфері реалізації національної безпеки та оборони України як правової держави. У ході дослідження проаналізовано ключові положення інформаційної безпеки, висвітлені основні аспекти прояву корупції в органах влади, що є прямою загрозою інтересам національної безпеки, здійснено аналіз реалізації базових конституційно-правових цінностей в умовах правового режиму воєнного стану, напрацьовано наукові положення та пропозиції стосовно гарантування реалізації конституційних цінностей у межах здійснення державної політики у сфері національної безпеки та оборони для забезпечення існування України не лише як суверенної та незалежної, але й як правової держави, а також трансформації існуючого правопорядку.The dissertation research provides a meaningful description of socially determined transformational processes in the sphere of realization of constitutional values of civil society. In the process of research, the most important key aspects of the leading institutions of civil society were highlighted, their role in the process of legal state formation was determined, meaningful directions of interaction with the state in the aspect of guaranteeing constitutional values were characterized, the innovations of Ukrainian legislation were analyzed and their practical implementation shortcomings were identified. The importance of constitutional values in the field of national security and defense of Ukraine as a legal state is emphasized. In the course of the study, the key provisions of information security were analyzed, the main aspects of the manifestation of corruption in the authorities, which are a direct threat to the interests of national security, were highlighted, the implementation of basic constitutional and legal values in the conditions of the legal regime of martial law was analyzed, scientific provisions and proposals have been developed regarding the guarantee of the implementation of constitutional values within the framework of the implementation of state policy in the field of national security and defense to ensure the existence of Ukraine not only as a sovereign and independent, but also as a legal state, as well as the transformation of the existing legal order.
