Еволюція правового статусу особи у домодерному та модерному міжнародному праві (кінець ІV тис. до н. е.–початок ХХ ст.)

Abstract

Дисертація присвячена комплексному дослідженню еволюції правового статусу особи у домодерному та модерному міжнародному праві кінця ІV тис. до н. е. – початку ХХ ст. У Розділі 1 здійснено аналіз історіографії проблеми правового статусу особи у домодерному та модерному міжнародному праві. Зокрема, було виокремлено та розглянуто групи вітчизняних та зарубіжних робіт, а саме сучасну історіографію еволюції правового статусу особи в домодерному та модерному міжнародному праві (кінець ХХ – початок ХХІ ст.), історіографію проблематики розвитку міжнародно-правового статусу індивіда в домодерну та модерну добу (кінець ХІХ – початок ХХ ст.), історіографію еволюції правового статусу особи в міжнародно-правовій думці російських та західноєвропейських вчених ХІХ ст. Аналіз сукупності вітчизняної та зарубіжної наукової літератури стосовно еволюції правового статусу особи в міжнародному праві домодерної та модерної доби дозволив дійти висновку про недостатність висвітлення даної проблематики, фрагментарність та різнорідність аналізу відомостей стосовно предмета дисертаційного дослідження.

The thesis is devoted to a comprehensive study of the evolution of the legal status of an individual in pre-modern and modern international law during late 4th millennium BC – early 20th century. Chapter 1 provides an analysis of the historiography of the problem of the legal status of an individual in pre-modern and modern international law. In particular, groups of domestic and foreign scholarly works were identified and considered, namely the modern historiography of the evolution of the legal status of an individual in pre-modern and modern international law (late 20th - early 21st century), the historiography of the problems of the development of the international legal status of an individual in the pre-modern and modern era (late 19th - early 20th century), the historiography of the evolution of the legal status of an individual in international legal thought of Russian and Western European scholars of the 19th century. The analysis of the totality of domestic and foreign scientific literature on the evolution of the legal status of an individual in international law of the pre-modern and modern era allowed us to conclude that this issue is insufficiently covered, the analysis of information on the subject of the research is fragmentary and heterogeneous.
